I have just been made aware of another fly by nighter making cheap copies of the "Ultimate Rod Holder" he is trading as nathanmn on Trade Me, using my images for his pictures etc. He is selling them for $690 no reserve, very interesting to see how the product compares to the photos and what research and development has been done.

I have reported this listing to Trademe as the user intends to defraud.

Below is my comments to Trademe in conjunction with my selection from their list of the user intending to defraud. Bye Bye "nathanmn":

"The fishing set he is listing is only available via one manufacturer and approved resellers. This person is not an approved reseller, and has used copied photos from recent magazines to promote an item he does not have for sale."

Surely there is some sort of copyright issue here as they appear to be exact copies of Andrew's Ultimate rodholder.

I appreciate that another fabricator could copy the measurements and make one but as far as I know they can't copy someone elses design.

If they are that clever they should design one themselves that is different.
Even though I don't actually own one of Andrew's rodholders I would if I could justify the cost - just a matter of catching fish to warrrant the outlay.

Anyway not sure of legal status of the other guy

They are not even copies as he DOES NOT HAVE ANYTHING FORSALE!!! Both are pics of Andrew skis one scanned out of a magazine and one from www.jetskifishing.co.nz. The useless loser can't even take a photo of what he has for sale because he has nothing..... BUYER BEWARE

Oh by the way I have a new Ferrari Modena and a Lamborghini Gallardo forsale for $50K each if any one keen. 50% deposit then you will be given more details and can test drive. For photos check out my pics on ferrari.com (the red one) and lamborghini.com (the yellow one) lol! As simple as that!!

competion keeps prices dwn theres no copywright on them so im suprised theres not more just my 2 cents .there will always be those people out there doing that. Evil or Very Mad

Don't get me wrong I am all for competition at the end of the day. However I don't like someone using photos of something that they are not even selling. Lets say this guy has developed a comparable rod holder kit....no worries but why not use your own photos of it instead of someone elses with a product that he is not selling.

It would be like BBQ Factory advertsiing their smokers but using photos of the Bradley Smokers from brochures or the internet. Somewhat misleading.

Correct, There is an Automatic copyright when you design a product in NZ, in the USA you have to register it. The copyright normally only extends to the design of the item, not the item itself.

If the guy re-produces a "Rod Holder setup" that is exactly the same as Andrews design, it is in fact in breach of copyright.

I know a good patent/copyright lawyer if you need.
